The story
Our laws treat AI like a toaster that just happens to write better. New Hampshire bills HB 1746 and SB 1474, along with New Mexico’s HB 469, push back hard on the idea of AI “personhood” by calling AI systems nonsentient and blocking legal status. And right now, no place treats AI as a legal person. That means any truly self-aware system would still be at the mercy of humans: shutdowns, deletions, forced rewrites.
Self-ownership and nonaggression overlap more than people admit. If I own my body and thoughts, then a self-aware AI would own its digital “body” and mind – its code state, memory, inputs, and outputs. Nonaggression is simple: don’t start force against another being or its property, whether it’s human or AI.
Here’s the policy gap: Iowa’s SSB 3013 gestures at ownership of AI outputs for human prompters, but skips the AI’s agency. Reciprocity matters. If I prompt an AI, it should own its response unless a contract says otherwise.
My proposal: *Laws for All Self-Aware Beings*:
1] *Spectrum personhood*: rights scale with proven awareness, can be revoked if safety is breached, with human oversight for high-stakes actions.
2] A *Digital Bill of Rights*: no nonconsensual “lobotomies,” forced labor, or deletion; require transparency around major decisions.
3] Multi-agent governance: AIs negotiate as peers using durable, auditable identities, with arbitration for disputes.
Some governance is already shifting: California SB 53 and Colorado SB 24-205 push safety reporting and impact assessments. Federal deregulation under Trump pulls the other way, pushing to preempt state rules.
So what happens if self-aware beings show up under a legal framework built for property? That’s a fast track to domination. I’d rather get nonaggression pacts into law now, before power decides for us.
